I
continued working on the project, (pg.,16) 6 and 7 days a week 8 to 12 hrs. a day, when around the last week of July Sheriff LaJoye and one of his
deputies come in the building where I'm working. The Deputy is looking around the room and LaJoye approached me and says "I'll
get right to the point and I'm not going to repeat myself, You're not now , never was and never will be a goddamn law enforcement
officer of any kind. You keep f_ing around with me or the judge and you'll wish to hell you was never born. As far as that
Toby mother-f_ _ ker go's the scared straight programs a federally funded program, f__k with that and you'll find your
ass in jail for impersonating a police officer" then he looks around and says, "I don't know what you
think your gonna do with all this f_ _ken junk any-way" then without me saying a word he turns around and leaves.
Lucky me I was working on a mannequin and had just rewound the tape for a message to be recorded, the moron was looking
right at me when I turned it on and didn't know what I was doing, now I have everything he said on tape. (e-mail) Aug./13/1993; Safetyville
is just about finished And I start having a custom built, tandem Axel trailer made for it. Aug.23; I have a few friends help
me put everything on the trailer, everything fits well and I put the electrical stuff, mannequins, tape recorders etc. in
the box of the truck we're hauling it in and we take it to a huge old furniture store where I have permission to set it up
for the finishing touches. We set it up, wire it and make a test run, I'm amazed how well it all works together and we take
it down, put it back on the trailer cover it with a tarp and park it at a friends farm and have more than enough money
left to buy every-ones dinner and a night on the town to celebrate. First week of Sept. 1993;
I call the local superintendent of schools and tell him Safetyville is ready for the beginning of the school year. He
said he was sorry, he was looking forward to this day but just last week Sheriff LaJoye called him and told him that I was
under investigation for fraud on the project and that he best not get involved with the project as it would look bad
for the schools. He then went on to say that LaJoye said that a lot of the material was stolen and some was purchased with
bad checks. I thanked the superintendent for his telling me. Although I had receipts for everything and never purchased anything
with a check, there was nothing I could do. I know LaJoye did what he did because I tried getting him busted for
stealing every bit of the money I had raised for the project in 1988, as well as trying to get the Shiawassee County Credit
Bureau for laundering the money that was by law supposed to have been deposited in the Shiawassee County treasury. Not to
mention the drug and extortion money that's still being laundered there to this day. (23)
Oct. 21 1993; Two Michigan State cops and a Shiawassee County cop arrest me on a warrant for selling
cocaine, (*) take me to the Shiawassee County Jail where Judge Lostracco, changes the charges
to 1 count of delivery of Codeine and 1 count of delivery of Dihydrocodeinone. With a cash or surety bond of $5,000. It seems
that 9 and 1/2 months earlier, Feb.5TH 1993 when I bought the oz. of pot from the waiter Lupe Garcia, State Police undercover
officer Jamie Corona charged me with selling him Codeine, rather than him selling me pot. (pg.16) (Now I know just who officer Jamie Corona is) and on Feb. 24Th. 1993 Corona charged me with selling him, personally,
10 Vicodin (dihydrocodeinone) tablets. I then knew the charge of the 24Th was made up at Coronas desk in Lansing,
That's not unusual for cops like him and officer Provost to do. Corona's the cop I was asked to look out for that
was robbing drug dealers and selling the drugs. I feel rather stupid when I think back to those days, through-out the
spring and into the summer of 93, I must have given Lupe a ride home at least a dozen times. I get a court appointed
attorney, Robert Hoschner, and give him witnesses names, signed and notarized statements and receipts, everything
proving that I was somewhere (bottom, pg.15) else on Feb.24Th, proving the charges were completely false, that I wasn't anywhere near
the restaurant on that particular day. Hoschner said he knew everything was a set up and he knew why, that he would see if
he could get me a good plea-bargain deal. I refused to discuss anything about a plea of any kind. (*)
On the way to the county jail we're all talking about different things, the state cop in the
front seat says they use Mexicans a lot because they make good liars. The state cop in the back seat with me says "I
lie, we all lie, we have to because of the courts. The county cop, driving asks me what Bill Mitchell has to do with anything.
I asked him what he meant and he says Mitchell gave LaJoye a $12,000 dollar finders fee for a 1967 Thunder-bird
convertible and my name was mentioned in the deal. I told him I didn't have any idea what it could have been about. Then I
went on to tell them about Mitchell killing Joe Kerns and about the skull that kept showing up. **from (23) While all of this is going on I find out that Lupe Garcia and a accomplice, in 1991, had broken into his neighbors house, terrorized the occupants, while holding
a gun to their heads and breaking into their safe. Dec. of 1992 Lupe is bragging to any-one that would listen that while
he was holding his neighbor hostage with a gun to his head trying to make him give him the combination to the safe "
The old bastard pissed his pants. He was so scared he couldn't even talk to give me the combination". Lupe is charged
and on June 26Th. 1992, convicted of, Count 1: B&E-Occupied Dwelling with intent to commit the crime of larceny therein,
Felony 15 years. Count 2: Safe Breaking with the intent to commit the crime of larceny, Felony Life or any term of years.
Count 3: B&E - A building with intent to commit the crime of larceny, Felony 10 years. (pg.19) The Honorable Judge Lostracco rewards Lupe Garcia with a job, working under
cover with his cousin Mi. state police officer (Jaime Corona Pg.15) making $100.00 (tax free) and up per bust of taxpayers money. Not bad for 5 minutes work and 10 minutes
of lies, times 100s of busts. Some time later the restaurant owner fired the scum-bag because several customers
complained that Lupe called them at home and some at work trying to get them to get him some pills or pot saying he really
needed it for his back. So now we got a extremely dangerous thief teamed up with a drug dealing cop at the beck and call of
a very crooked judge, sheriff and prosecutor. If that's not enough of a crime wave think about this. (20) In 1985 Lupe's brother Frank Garcia (21) was arrested and charged with killing a pizza delivery boy. He was convicted of Murder-2nd degree, Armed robbery, Auto Theft
at gun point and Felony Firearm. The original charges was Ct.1 1st degree murder, Ct.2 Felony murder, Ct.3 Felony firearms.
Of course he gets out of prison in 6 mos. on a technicality, (pg.14) same as Tank Toby, the heroin dealer. Anyone can literally get away with murder in Mi.
if they deal with the right people and/or have oodles of money. Another cousin, Jesse Garcia is busted for Ct.1 Assault/bodily
harm less than murder, Ct.2 Malicious destruction of property. Locally it's all called Judge Lostraccos Mexican connection.
Though this all sounds bad for Mexicans keep in mind , Owosso has a rather large Mexican population for its size with the
vast majority of them being fine people, as good and upstanding as any community could ever hope for. About Feb. 20Th 1994: I get a letter from my court
appointed Attorney Ralph Hoschner, stating; The Circuit Court has set your Arraignment in this matter for Friday, March 4,
1994 at 9:30 a.m. in front of Judge Lostracco. I will see you in court at that time. When I meet Hoschner at the court house
he tells the hearing is postponed because of the Mitchell trial and it's just getting started and asks me to go in the court
room for a minute with him because he wants to listen in on some of it, when we come back out he will reschedule a pretrial,
that his secretary made a mistake when she put down arraignment. It seems that Bill Mitchells
wife had filed for a divorce, so he charges her with trying to kill him by tampering with his
medications and to back his story up he's stating that she had plotted back in 1960 to have him murdered for the insurance
money and he had statements from the people that she had plotted with stating that she put them up to it. See
(*), (pg.14) We leave the court room and Hoschner tells me he will call me and let me know when the
new date is set for the pretrial. The next day, March, 5Th, I see part of the trial on TV and call Mrs. Mitchells lawyers
from Lansing and tell them that Mrs. Mitchell didn't have anything to do with the plot to murder her husband back in
1960. They make a appointment for me to meet an investigator, we meet on March, 7Th, and I give him a taped statement that
Mrs. Mitchell wasn't involved at all with the failed attempt on his life in 1960. The next day, March 8Th, Mr. Mitchells lawyer
calls me and asked me to come in and see him, I had known this lawyer for a very long time, when I went to see him he
wanted to pay me $500.00 to tell him how to get in touch with H.M. and Bob B.The two guys that had got Joe Kerns to kill Mr.
Mitchell in 1960. He let me read the statements that they was supposed to have signed back in 1960 (also on pg. 14) stating that if they came back to Mi. they would be charged with attempted murder. The statements said that Mrs. Mitchell
had put them up to it and all but I could see right off that the statements were not the way H.M. or Bob B. talked, not the
way H.M. related it to me after he showed up from the hospital and certainly not the way they talked about it in front
of me. I told the lawyer R.S. that I didn't know where they were and left. Also on March 5Th. I get a letter that was
dated March 4Th and must have went out in the mail while I was sitting in on the Mitchell trial with Hoschner that same
day. Stating; Please be advised that the Circuit Court has scheduled your Pretrial for Friday March, 11, 1994 at 8:00 a.m.
in front of Judge Lostracco. I will plan on seeing you in court on that date. When I get to the court house Hoschner
says the Mitchell trial is still going on and the pretrial has been postponed again, and wants me to go in the court room
and meet Mrs. Mitchell, he will reschedule my pretrial when he gets back to his office. We go in the court room and it's pretty
crowded but there just happens to be two seats open right behind Mrs. Mitchell, next to her local attorney. Hoschner introduces
us and we leave. I knew this was a set up to make sure that I got the idea that Billy Mitchell was upset with my
trying to get him looked into for the murder of Joe Kerns as well as telling Mrs. Mitchells lawyers about her
not being involved with the 1960 ordeal. By the way this was the first time I had ever saw Mrs. Mitchell. Hoschner has
me walk over to his office with him. (cont.,pg.18)
