He looks
at his calendar and tells me to call him around the last part of the month. I call him the last of March and he
says the pretrial is scheduled for Tue. April, 5Th at 9:30 a.m. I go to the court house on the 5Th at 9:30
a.m., I look around for Hoschner and he's nowhere around, so I Ask judge Lostraccos secretary about the pretrial and
she says there's no pretrials scheduled for that day. I call Hoschners office and he comes over to the court house
and tells me he waived the pretrial because he thought I wanted him to, I went ballistic and he tells me he thought
it was better that we didn't have a pretrial because Corona and Lupe wouldn't have a chance to get there stories together
before trial and none of there lies would be on record. I tell him that I wanted everything they had to say on record because
everything was a lie. By now I'm yelling at him and he takes me into the stair-well and is trying to calm me down and says
he will talk to the Judge. He goes into the judges office while I set outside the door, all I can make out is the
judge yelling a bunch of profanities at him. He comes back out and tells me he's really sorry, that he has Manic Depression
and that is the only thing that he can think of that would make him think I told him I wanted the pretrial waived. He then
says how about I see if we can get you an entrapment hearing instead? I know you asked me about it before and the judge wouldn't
allow it but under the circumstances he might allow it now. I said OK. Hoschner went back in the judges office, came out a
few minutes later and said the judge would allow me the entrapment hearing and he would send me a notice when it was scheduled.
About the 23Rd of May I get a court document saying
RE-Notice OF HEARING, signed by Hoschner dated May 18Th, stating that a entrapment hearing is scheduled for June 2Nd 1994
at 9:00 A.M. and that it will be heard by a visiting judge Kathryn Root. (of course Lostracco ends up doing it). A couple
days later I go to the court house to look up some files and I meet a young man I had known since he was a child, (Scott
Burrow), he was just leaving the court house as I was going in. He asked me to meet him at the restaurant across the
street as he wanted to tell me something. (pg.8) I met Scott in the restaurant and he tells me that he overheard Sheriff LaJoye talking to prosecutor
Randy Colbry and judge Lostracco about me, saying, "I promise you one thing , when the ole judge puts him back in
my jail the son-of a bitch won't walk out alive". While were talking a pretty young lady, the waitress that's serving
us shows us her smile, she has a tooth in the very center of her mouth (upper) she said that she went to a dentist to get
a tooth taken out of each side of her mouth and the dentist took 2 teeth out on the same side crowding her teeth over on the
one side. Her parents tried suing the dentist who was a friend of the judge, Lostracco, who dismissed the case for lack of
evidence. I asked Scott if he would be willing to tell my lawyer Hoschner what he had just told me, he said he would so we
walked across the street to Hoschners office (which shares the parking lot with the court house) and he gave Hoschner
a signed statement in more exact detail. Where he was, where LaJoye, Lostracco and Colbry were and how he knew they were talking
about me. I will always regret asking him to do that.
Around the end of May, I went to Hoschners office to discuss the upcoming entrapment hearing with him. I asked
Hoschner if I could subpoena any witnesses. He said yes if I could come up with the money but it would
be a waist of my money because the judge wouldn't allow any without knowing who they were and what they might have to say
beforehand. I told him that I had nine people in mind that was at the restaurant on the day of Feb. the 5Th and several that
would testify as to where I was on the 24Th. He said no way would he (the judge) allow that many witnesses to say anything
contradicting the officers testimony. I say "well how about the trial? can't I have any witnesses there either?".
Hoschner says "the best thing you can do is get sworn , notarized, statements from everyone you can and hold on to them".
I asked him if I could have the restaurant owner testify that I wouldn't have to subpoena him, he says I'm sure you can but
I will have to notify Collins. (the prosecutor) I said I already talked to Benny, (Bernard Hernandez, the restaurant owner),
he will come but the help would have to be subpoenaed so would the customers that was there on the 5Th because they would
have to miss work. Hoschner says the restaurant owner would probably be OK but no-one else. Then he wrote down a name and
address and handed it to me and said this is the association for the defence of the wrongly convicted in Toronto, Canada,
you might want to contact them. I never gave you that OK? I said OK. Then he says "We never discussed anything today
except your one wittiness right" I said right and we talked awhile longer and I left. (June 2Nd) I show up for the entrapment
hearing with Mr. Hernandez and the hearing gets underway.
The first order of business is prosecutor Collins calling Mr. Hernandez to the stand, swearing him in, verifying his name
and occupation and the first question he asked him was "Do you smoke Marijuana?" Mr. Hernandez said "no"
the second question was "have you ever been arrested for Marijuana?" Mr. Hernandez said "no" then Judge
Lostracco explained the 5Th amendment to Mr. Hernandez and said if he didn't want to answer anymore questions of
that nature that he should take the 5Th amendment, which he did to the next several questions and then was dismissed from
the stand. Then the prosecutor calls Michigan State Police Officer Jaime Corona to the stand where his lies don't even match
the lies that he had put on his complaints. Some of Coronas antics, like explaining how I walked into the restaurant
holding a baggie of drugs at arms length and eye level, with a very exaggerated accent saying "It
never left my sight" (pg.8) while the honorable Judge Lostracco is smiling, making a complete mockery of his court as well as his
and Coronas profession. Now his honor says that because my witness took the fifth that he didn't count and set a trial
date for June the 6Th at 9:00 A.M. END of hearing.
It takes me a couple of days to talk to the 14 people I want subpoenaed, I have there names, addresses and exactly
where they can be reached to be served the summons for trial and give all the information to Hoschner. The evening of June
5Th I set up a meeting with a friend for him to meet me at a coffee shop at 8:00 A.M. on the morning of the 6Th to take me
to the international bridge at Port Huron Mi. so I could hitch-hike to Toronto Canada to the place Hoschner suggested, if I
needed to. With what Scott had told me and the entrapment hearing out come I knew that if I survived the Sheriffs
promise, I would be put in prison for at least 17 years on Coronas charges. pg.(23). I decided I wasn't going to just lay down and let them kill me. At 8:20 a.m. I call Hoschner and he tells me
everything is set for the trial to start at 9 o'clock. I ask him if he got the subpoenas all served, he said he couldn't get
any of them served "you knew that would happen, right?" then he said every-thing's set to go to trial,
"I don't know about the jury though, I protested 5 of the jurors, 2 was convicted felons and 3 of them was due
to be tried pretty soon" He was still talking when I interrupted saying "I'll call you back in a minute, OK,
I gotta go". I hung up and had my friend drop me off in Port Huron, took a cab across the bridge to Sarnia Canada and
hitch-hiked to Toronto. I get to Toronto and go to the address Hoschner gave me and talk to Paul Copeland, the name he put
on the paper, Paul gives me a address and name of an associate in Chicago, (Robert Baldori) I thumb it back to Flint Mi. and
call Robert in Chicago and he has me call a lawyer in Lansing Mi. (H. Eugene Bennett) I call Bennett and thumb it to Lansing.
Mr. Bennett wants a $6,000 retainer, I borrow the 6 grand and give it to Bennett and on June the 21St Bennett takes me to
the Shiawassee County jail where I turn myself in and am charged with absconding bond and Aggravated stalking. My bond
is now $150,000. (cont.,pg.19)
