Feb/15: In the next 10 days he visited her 2 times but didn't go in the station. Toni went outside and talked to him
in his patrol car. After one of the visits, Toni went back in the store and told the two employees who were keeping me
updated that she might need them to make out some statements to back her up on some things that she had to tell Provost.
Feb/28: Provost went back in the station and Toni told
him that I was calling her manager and filing complaints against her and telling the employees that the reason they couldn't
accept tips was because of that manager. She then gave him a copy of a corrective action notice. Provost told her that he
would get it right into the prosecutor and that she should call the prosecutor and see if that would be enough for
them to act on.
The next day Toni
called the prosecutor's office and told the employees the prosecutor told her that he would let her know when to expect some
action on the complaint, and that she would have to come in next month around the 16Th or 17Th and file a personal protection
order against me. One of the employees asked her for what, and she said she thought stalking, but had to talk to the
prosecutor again first.
March/16/06:
Two state police cars pull up to my house. An officer comes to my door with an arrest warrant charging me with 5 criminal charges
of Telecommunications services-Malicious use, (MCL 750.540e,[750.540E], handcuffs me and hauls me off to the Dickinson
Co. jail. The deputy at the jail asked me my name, date of birth and other identifying information and told me to sign
the form. I asked her if I could read it. She grabbed my arm, took me to a cell and locked me up for 25 minutes. Just
locking the cell door took longer than it would have to read the form. I'm then released on a personal recognizance bond with
a court appearance set for March 22/06, before the honorable Judge Kosz. The arresting officer didn't ask me any questions.
I was told for that reason he didn't have to read me my rights.
March 24/06: The Animal Control officer served me a Personal Protection Order Against
Stalking, (Non Domestic). Mrs. Christian had filled it out on March the 17Th, the honorable circuit court Judge Mary
Barglind signed it March 20Th. When the animal control officer served the PPO he told me that I should call Mrs. Christian's boss
and let him know what she was up to. I tried to talk to the owner but was told he was out of town.
My first encounter with Mrs. Christian was about May of 2005.
I was putting air in my tires when I saw Toni kissing a man, (I thought at the time it was her husband), and heard him call
her back to his truck, calling her Toni. I had known for about a year that the person who owned the dogs was named Toni
and that she worked at the BP station, but I didn't know who Toni was. I followed her into the station and said,
" Are you the lady who owns those dogs across the alley from Art Burns' old place? ". Toni said, "Yes,
why?" I said "Could you maybe tie them out front or on the other side of your house? I have sleep
apnea and they wake me up about 6 every morning." Toni- " Dogs do bark. Anyway they're not my dogs they're Tom's"
Me- "Can you give me his number? I'll ask him." Toni- "I wouldn't bother him if I were you. He can get pretty
upset over those dogs, and he's a pretty big guy." Me- " Thanks, have a nice day," and left.
March 22/06: Arraignment day, Judge Kusz presiding.
I plead not guilty to 5 counts of malicious use of a telecommunications device and ask for a jury trial and a court appointed
attorney. Trial is set for Friday, May 19Th at 9:00 a.m. My court appointed attorney is Nancy Schaub. She is sitting
by the door and gives me her business card with an appointment date of Friday, March 31st at 1:00 p.m. I go to the appointment
and find that the prosecutor's office didn't send the charges or anything to Nancy yet. Nancy calls them and tells me to come
in on the following Monday to pick them up. Monday April 3rd. I go back to Nancy's office and get to see
the complaint that trooper Provost and Mrs. Christian started working on Thursday, Feb.2nd. The complaint starts with
Provost saying:
" while on patrol,
I (Tpr. Provost) received a dispatch to contact the below listed complainant at the BP station in Sagola, Mi. reference harassing
phone calls. I advised dispatch and immediately went to the scene". (cont.5)
