THREATING LETTER (7)

     Feb/08/06: About 7:15 a.m. I walked over to the BP station, ate breakfast had some coffee while I waited for 8 o'clock to call the Counsel & Advocacy Law Line. While I'm waiting, 3 of the employees are in the deli complaining about Toni, their manager, notifying them that the owner said if they kept accepting tips that he would cut their wages. About a week before this one of the deli workers husband ripped the no tipping sign off the counter and wadded it up and threw it on the floor. I had offered a tip and was told that Toni was watching for anybody taking tips so she could fire one of them.

    8 o'clock Central time, 9 o'clock Southfield time. My reason for calling Southfield is I was in touch with the Marquette office on a S.S. issue and talked to a lawyer there about Mrs. Christian's dogs. That lawyer gave me the number of their main office in Southfield, Mi. When I called the office in Southfield I talked to a lady lawyer named Lisa Waldvogel. That conversation was Lisa telling me that there really wasn't much she could do and if I felt Mrs. Christian was leaving her dogs out to get even with me, that I could take her to court for harassment and cruelty to animals. I told Lisa that I was the outsider here and I wouldn't do anything anyway without my landlord's OK. Lisa wished me luck and asked me to keep in touch and let her know how things turn out.

   Feb/8/06: After Provost left that morning, I called Southfield again and was told to call Lisa back the next day. Feb/09/06. I called Lisa and told her about State Police Trooper Kevin Provost's visit the day before and that I didn't think it was a coincidence that he came to my house right after I had called her. I was sure that Toni had listened in on the pay phone extension. I also told her about my ordeal with Provost three years before. Lisa said "I want you to sit down as soon as we're off this line and write down everything you and the police officer discussed while it's still fresh in your mind. Be as accurate as you can be. I will write your neighbor a letter and maybe we can put a stop to this before it goes any further". Me- "What kind of letter?" Lisa- "I won't if you don't want me to Mr. Eldridge" Me- "It's not that I don't want you to, I just don't see where it can do any good". Lisa "Would you be willing to sit down and discuss it with your neighbor with a third party who wasn't involved in any way ?" Me- "Yes, but I don't think she's capable of doing anything decent or peaceful for that matter". Lisa- "Well, I like to think there's a little good in everyone, Mr. Eldridge. I will write your neighbor and ask if she would be willing to sit down with you and settle your differences in a peaceful manner. You just might be surprised how people can react when they learn how much discomfort they've caused another". I guess Toni got the letter on Feb/13th. Provost says he talked to her on the 14th and that he sent a copy of it in with her complaint the 15th. Provost- "Christian also advised that she received a letter in the mail on 2/13/06, which appears to be some type of threatening letter Eldridge had had sent to her (copy is attached)". The letter that Lisa wrote to Mrs. Christian;

Dear Mr. and Ms. Christian:

    I am writing you on behalf of your next door neighbor, Mr. Byron Elderidge.

    I understand that he has been having concerns about your black and Blonde Labrador retrievers who, according to Mr. Elderidge, have, particularly in the past several months, quite frequently been barking incessantly. I also understand that Mr. Elderidge has attempted several times to call animal control and has even complained to the state police.

Since our conversation yesterday morning, Mr. Elderidge said that yesterday was a most pleasant day and that the dogs did not engage in what has apparently become their normal barking pattern. I thank you for whatever you were able to do to keep the dogs from barking!

    I have assured Mr. Elderidge that surely he and you can maintain a harmonious and neighborly coexistence. Mr. Eldridge has felt in the past that perhaps he is being punished for his complaints to animal control and also his complaints to you. He said that very often, when he complains the problem only gets worse! I advised him that this pattern of behavior can be construed as harassment and also advised that if the situation warrants, he could apply to the court for an anti-harassment order.

    It is not my intent to encourage any litigation regarding this matter. It is my intent to help in any way possible to try and help you both resolve this dispute. If you would like to discuss this matter further, I would be most happy to talk to either or both of you. Another suggestion would be for you and Mr. Elderidge to go to a mediation session. The purpose of a mediation is to bring about a peaceful settlement or compromise between disputants through the objective intervention of a neutral party.

    The following is Toni's statement exactly as she printed it on the PPO:
I was getting prank phone calls the person call approximately 2 X barking on the other end. Maybe a week later I get 3 more right in a row. The first one I hung up. The second one I let my answering machine get it. The third one I (looks like piqad) up my phone but I did not say anything because I wasn't sure who it was. When noone said anything on the other end I responded by saying " Leave me alone" and then the barking started. I did not know who was doing this because caller ID said private caller. After I thought for a minute I realized who it was, my neighbor Byron Eldridge. He had recently made complaints about my dogs barking. On February 8, 2006 I spoke with trooper Kevin Provost about the phone calls. He talked to Mr. Eldridge and he admitted making the phone calls. He told the officer that he wouldn't guarntee that he would stop harassing me. A few days later a few girls I work with told me Mr. Eldridge came into my place of work and made a few comments about me. Which later my boss wrote me up on these false statements. And lastly, on February 13, 2006 I received a letter from the counsel & advocacy law line that I was letting my dogs out barking & and that was Anti Harassment. My dogs  do bark but I let them after 5 minutes Not hours as he claims. He also watches my house as to my comings & goings.

    Mr. Eldridge has been arrested for these incidents. I had filed a police report on Feb.8,2006 and the prosecuting attorney issued a warrant for his arrest on March 16, 2006 Antoinette Christian 3/17/06.

     After I saw Nancy Schaub I decided I needed a lawyer who didn't work for the court and called Peter Kivisaari. Although (because?) the local paper printed a negative thing about him, it also said he turned in a 26 pg. report. Knowing something about the area told me all the lawyers are controlled by the judges and Peter would go as far as he could to prove my innocence. First he gets the trial moved to June 19th, 06, and files for a motion to (cont.,pg.9)
