    (continued from pg.7) Dismiss and to keep Provost from testifying and had the jury trial date moved to June/19/06. The prosecutor's office offered a plea of dropping 4 charges if I would plea to 1. Hearing to keep Provost from testifying, (Jun/17/06) The Honorable (pg.21) Judge Kosz (pg.15)throws out a Michigan Supreme Court ruling People V. Gallego., Mich. 433/ 1988, stating that it is necessary for the police to lie and (23) make promises with suspects because of terrorists. (X) I had fired Kivisaari the night before this hearing for going a little too far in trying to get me to take the prosecutors offer from the day before: If I would NOT go to the hearing I had scheduled to get the PPO terminated they would drop all the charges (with prejudice). Kivisaari said he had to go to the hearing, and is now saying to me "The judge is allowing Provost to testify. Juries always believe the police officer". Will I reconsider the prosecutions offer?" I said "fine, I'll tell the jury everything the liar says is true and I told him that so he wouldn't have to lie under oath". Kivisaari says something to the judge. The judge says something and Kivisaari explains that I was going to fire him last night. Then the judge says to the prosecutor "You should drop the charges and recharge him with stalking. That carries a longer sentence".

   Now we take a break and Kivisaari isa pleading with me just to go over and talk to prosecutor Downing. I realized Kivisaari's position and went over to a corner of the court room where Downing is cowering and said, "Ain't you the guy who was in traffic court a couple years ago?, Downing, "I do the traffic court cases". Me, "I don't want to talk to you". The hearing ended.

   The following is the response to the first question of discovery.

   NOW COME the People of the State of Michigan, by and through Lisa M. Israel, Assistant Prosecuting Attorney, and states as follows:
No.1 The people may call the following witnesses to testify at trial: Trooper Kevin Provost C/o Michigan State Police - Iron Mountain, Michigan 49801; Antoinette Christian 303 Sagola Avenue, Sagola, Michigan 49881; Laurie Bray C/o BP Station, Sagola, Michigan 49881; Bud Miller C/o Dickinson County Sheriff's Office, 300 East D. Street, Iron Mountain, Michigan 49801; In addition, the People may offer the following exhibits at trial: Letter to the Christians from Lakeshore Legal Aid's Counsel & Advocacy Law Line dated February 9, 2006 and Employee Corrective Action Notice for Antoinette Christian, dated February 17, 2006.

   Apparently trying to settle anything  peacefully is illegal in Mi., Bud Miller, is the Animal Control Officer who does his job well and is an honest man. Laurie Bray was Toni's supervisor, good honest lady. I was going to subpoena both of them, but the prosecution saved me the trouble.

That assistant prosecutor, Lisa M. Israel, has a very warped sense of justice. The hung jury cases she Say's she's not going to pursue any further because she feels it's, "Not in the best interest of justice" (DUH). Lisa's boss Chris Ninomiya has recently been appointed a board member of the Michigan Prosecuting Attorneys Association. I imagine the first laws he will introduce will be to make it a felony for anyone who has been charged with anything by a prosecutors office to refuse a plea offer, and all defense attorneys must be court appointed.

    The next day (June/18th), the day before the trial, the prosecutor's office dropped all charges, (without prejudice), meaning for the next three years if Toni and/or Provost want to further lie and perjure themselves they can still make trouble for me and continue making the taxpayers pay for it. The prosecutor's office was supposed to return my fingerprint records also. They haven't yet, and I don't think they will. They're no doubt saving them for Provosts next conspiracy. Chief prosecutor Carl Downing can keep charging me over and over and wasting taxpayers money for years to come, and I'm powerless to stop him.

    Provost (pg.1) June/21/06: Termination hearing. As I get to the court for the termination hearing I see Provost and Mrs. Christian and I go in the bathroom. Provost comes in and says "An old friend of yours said hello". I didn't say anything and Provost says, "Jaime Corona", and left.

    I went up to the court room very upset knowing exactly what Provost meant, and scared that the crazy liar might shoot me at any time in the court house. With corrupt judges to say I was putting their lives in danger, and he was their hero protecting them. The P.P.O. hearing begins with the Honorable Judge Mary Brouillette Barglind presiding. I'm now feeling confident that things have to go my way. I'm armed with the 5 criminal counts dropped, the discovery statements that there are no known telephonic recordings, no known statements from anyone, including Toni's boss who she said had given the prosecutor a statement that I had called him, pictures of my house, clearly showing Toni's house was impossible to see from my house. The letter of good faith from Lakeshore Legal Aid, reports from animal control stating Toni's dogs were constantly barking and someone other than me had called them! Proof that every last detail of Toni's and Provost's statements were lies including the phone records that I had to pay for and furnish. 

    None of this even fazed Judge Barglind. (pg.15) She was, however, very impressed with officer Provost's new crime fighting tools that Judge Kosz awarded him, (the OK to lie under oath), and the lies he added that weren't on his statements. He even lied about the arresting officer, saying he told him that I had admitted to him that I had made the phone calls. Then Provost told her that they had to drop all the criminal charges and that I wouldn't plea-bargain. Judge Barglind was visibly shaken with several emotions coming through at the same time. With a look of stark horror, while glaring at me with such hatred for my despicable act of refusing to plea bargain, blurting out "HE WOULDN'T PLEA-BARGAIN!" (X) She then went on to find that I was a horrible criminal who Mrs. Christian should be protected from.

    After Provost made his remark about trooper Corona and the hearing was over, I called every agency I could think of to keep Provost away from me. It all came down to the F.B.I. telling me to call the local sheriff. I called the Dickinson Co. Sheriff's Department and told the lady on dispatch that the F.B.I. told me to call there and why. She told me to leave a message for the sheriff and transferred me to his voice mail, I left a message and have not heard anything from him yet, (over 6 mos. ago).

    It just sickens me to know that over 3,000 young men and women have died in Iraq in the name of justice, while back here in their country the police, judges and prosecutors commit outright conspiracy to punish their fellow Americans for seeking the very justice those kids are dying for. What are we headed for as a society when the police and judges have put themselves so far above the law, wasting the country's wealth on hatred and revenge, committing crimes that they are sending others to prison for.
